Motor Vehicle Accidents

Car crash!It happens so quickly

Motor vehicle accidents are the most common cause of Personal Injury, and few people are prepared for the lengthy and frustrating process of collecting compensation for their injuries from the auto insurance companies.

It is important to get legal advice before signing any anything. You could inadvertently give up all your rights. One of our Nevada or California auto accident lawyers will be happy to provide a free consultation. Just contact our office and we will evaluate your case and give you an honest opinion of the insurance company’s offer.

This general advice applies to car, truck, or motorcycle accidents, as well as accidents involving pedestrians, bicycles, tractors, or all-terrain vehicles (ATVs). Injuries may involve soft-tissue damage, bruises, back and neck injuries from an airbag, internal bleeding from a seat-belt, and fractures; and may require simple treatment or result in major disabilities including amputation, brain damage, or paralysis; even death. Whether the auto accident was a rear-end crash, a pile-up, or a collision with a city bus there may be one or more policies to help with your expenses.

What to do after an auto accident:

At the scene, get the following information:

  • license plate number and owner’s name from each vehicle involved
  • for each driver: their name, address, phone number, driver’s license state and number
  • law enforcement officer’s badge number, name, and information on where to pick up a copy of the accident report
  • photographs of: all sides of all vehicles, the intersection or site of the wreck from all directions, any obstructions to view, debris, skid marks, any visible injuries (especially bruises)
  • witnesses: talk to each and get a name, address, telephone number (If you come back to the scene at the same time next week, you may find witnesses who you missed the first time.)
  • examine your vehicle, and if it will be towed, get personal belongings out first and write down the name and number of the towing company

Be very cautious about giving a statement to your insurance company.

You may feel no need to be cautious, particularly if it seems clear the accident was not your fault, but your comments about the accident or your injuries may later be used against you.

If you are in any way injured, get medical care as soon as possible, and begin a record, including photographs, of your injury and treatment. If you fail to get care the insurance company will argue you were not hurt.

Identify all sources of compensation for your injuries:

There may be several sources of compensation for your medical expenses, lost wages, permanent disability, and pain and suffering following a car or motorcycle accident, including MedPay, uninsured motorist, and underinsured motorist coverage. If you may be out of work for twelve months or more, you may qualify for Social Security disability benefits. Contact a lawyer familiar with California or Nevada auto accident insurance claims for help in identifying possible payers.

File your claim before the statute of limitations runs out!

Time limits for filing claims vary from state to state, and may depend on whether the injured person was a minor, or whether the vehicle causing the accident was a government vehicle. You must file your claim before the time runs out. One phone call to David Allen & Associates for a free consultation can prevent a loss forever.
