Products that Cause Injury

Federal and state laws require manufacturers and distributors of products to pay for injuries caused as a result of defective products.

Product liability is the responsibility an industry to pay for injuries caused by its products. In most cases, the injury was caused by a defective product, and when it has been demonstrated that the product defect was the cause of injury the matter to be decided is the amount the injured person should recover for medical expenses, pain and suffering, lost wages, and permanent disability. At our Personal Injury law firm, David Allen & Associates, we successfully represent people injured by poorly designed or defective products.

It is not easy, however, to show that a product was defective. Product liability lawyers at our California and Nevada law offices use laboratories and scientific experts to help in that process. In some cases, it is already established, through a product recall, a product was defective. If you feel a defective product caused your injury, it is important to hold on to the product, whether it caused a sports product injury, or an air bag injury or if the product was a dangerous power tool or a defective household appliance. It is good to take pictures of the product and have it analyzed as soon as possible.

Food poisoning from restaurant food is a difficult claim to prove, since your doctor may not have recognized the problem. If you feel a pizza, salad bar product, or other food caused you to become ill, seal the food and any packaging in plastic and have it analyzed immediately if possible. If necessary, freeze the evidence. This will allow it to be tested later. If, however, you keep it frozen for a long time or freeze it at very low temperatures, you might destroy the germs that caused your illness.

A list of product recalls can be seen at the American Trial Lawyers Association. As with other Personal Injury claims, there is a statute of limitations. Product liability claims in California and Nevada must be filed within two years of the accident.
