Are you unable to work because of a physical, emotional or mental disability?

You may be unable to work for a year or more because of a mental, emotional or physical disability brought about by injury or illness. Do I need a Social Security Disability Lawyer to get those benefits?

Certainly you can apply for Social Security Disability benefits without a lawyer. However, the majority of applicants trying to establish Social Security Disability eligibility are turned down. Most of the people who get Social Security Disability benefits are awarded them after a hearing in which they are represented by a lawyer. If you lose at the hearing, the next step is an appeal where you are limited to the information presented at the hearing.

When should I apply for SSDI/SSI benefits?

Even if you expect to be back at work within a year of your illness or injury, you need to apply as soon as it appears your disability will go on for six months or more. Sometimes the disability lasts longer than anticipated. The sad thing is it takes the Social Security Administration a long time to process a claim and if you wait to be disabled for a full year before applying it may be two years or more before you are approved for benefits.
